Terms of Service

1. Acceptance of Terms

By accessing or using Atlyn's website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Service Description

Atlyn provides free and paid custom visuals for Microsoft Power BI, as well as optional paid services. Our Services include the Atlyn website, downloadable Power BI visual packages (.pbiviz files), and related account management features.

Atlyn Markdown Viewer, Atlyn Bullet Chart, and Atlyn Tornado Chart are free for personal and commercial use under the MIT License. No purchase, subscription, trial, or payment is required to use these three visuals.

3. Account Registration and Security

If you create an Atlyn account or use an applicable paid offering that requires one, you must sign in with a valid Microsoft account. You are responsible for maintaining the security of your account and for all activities that occur under it. You must notify us immediately at atlyn.help@gmail.com if you suspect unauthorized access.

4. Subscription and Payment Terms

This section applies only to paid visuals and optional paid services offered on a subscription basis. It does not apply to the three free MIT-licensed visuals named above.

  • Free trial: Each applicable paid visual includes a 30-day free trial with full feature access. Starting such a trial requires a payment method, but it will not be charged until the trial ends. Cancel before the trial ends to avoid a charge.
  • Billing: Subscriptions for applicable paid offerings are billed monthly or annually, depending on the plan you select. Payment is processed through Stripe.
  • Auto-renewal: Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
  • Cancellation: You may cancel a paid subscription at any time from your dashboard. You will retain access until the end of your current billing period.

5. License Grant

Upon subscribing to an applicable paid visual, Atlyn grants you a non-exclusive, non-transferable, revocable license to use the subscribed visual(s) in Power BI reports for the duration of your active subscription.

The license grants for Atlyn Markdown Viewer, Atlyn Bullet Chart, and Atlyn Tornado Chart are governed by the MIT License. Section 4, the revocable paid license in this Section 5, Sections 6 and 7, and Section 9 do not override, narrow, or revoke those MIT license grants.

6. Restrictions

For applicable paid or proprietary offerings, except as permitted by an applicable license or law, you agree not to:

  • Reverse engineer, decompile, or disassemble a paid or proprietary Atlyn visual.
  • Share, redistribute, or resell a paid license key to third parties.
  • Use the visuals in a manner that violates any applicable law or regulation.
  • Attempt to circumvent paid licensing restrictions or access controls.

7. Intellectual Property

Atlyn retains its intellectual property rights in its visuals, software, designs, trademarks, and content. Open-source software remains subject to its applicable license, including the MIT License for the three visuals named in Section 2. A subscription to a paid offering grants only the applicable license, not ownership of any intellectual property.

8. Limitation of Liability

To the maximum extent permitted by law, Atlyn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid to Atlyn in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, access to applicable paid services ends and any paid visual license conditioned on an active subscription is revoked. Termination does not revoke or limit rights granted under the MIT License for the three visuals named in Section 2. You may also terminate your account at any time by contacting us.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through our website. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
